On Gov Fayemi's Mischief on Restructuring





The attention of Afenifere has been drawn to the statement credited to Governor Kayode Fayemi at the weekend that restructuring idea will remain  a mirage except proponents of it in Yorubaland reach out to other regions .
We would ordinarily  have ignored such unkind cut if it had come from any ignorant fellow. 
But His Excellency cannot be counted among the ignorant and could only have been mischievous in making such revisionism. 
For the generations under 60 in Yorubaland,Chief Obafemi Awolowo was criss -crossing the length and breadth of Nigeria before they were born on the issue of federalism that would benefit the whole country and not only the Yoruba .
Chief Awolowo's extensive works among the minorities of the South and the North to the point of placing a lot of their leaders on same level of allowances with Ministers in Western Region was part of his efforts to galvanize national consensus around federalism. 
Since the exit of the great Leader,his disciples have never neglected the path of reaching out to all sections of the country at every point in time to build national consensus .
At the 2014 National Conference for instance,Yoruba delegates worked nights and days with Leaders across Nigeria to build consensus which led to over three  hundred resolutions that would have moved Nigeria forward if implemented, without the use of ballot once .
In the last four years that the APC government ,which Fayemi is part of,has made the idea of restructuring a "mirage " in spite of deceiving Nigerians with Federalism on their manifesto in 2015,proponents of restructuring in the South West have worked with other regions in the Southern and Middle Belt Leaders Forum and the Nigerian Leaders and Elders Forum which  included Northern Elders Forum to promote the idea of federalism. 
The map of the last presidential elections with all the manipulations still showed the result of what have been achieved in this regard. 
Instead of shifting the blame  on  proponents of restructuring ,a governor with testicular fortitude should have found the courage to reach to the only "region" stonewalling the restructuring of Nigeria -the Buhari presidency,in spite of the El-Rufai Committee report which now appears a mere attempt to hoodwink tgr unwary. 
If some politicians from the region are enslaved to an anti-progress leadership and have lost their voices for self -preservation,they should be careful in insulting leaders from their region to impress their masters .

Innoson Vehicles Manufacturing, a Nigerian automobile company, has claimed that it has obtained a nod from court to take over Guaranty Trust Bank, one of the largest deposit money banks in the country.

In a statement first shared on its Twitter page on Friday, Innoson said the Supreme Court upheld the ruling earlier given at the federal high court in Ibadan.

The statement released by Cornel Osigwe, Innoson's head of corporate communications read: "The Chairman of Innoson Group, Chief Dr Innocent Chukwuma, OFR has through a Writ of FiFa taken over Guaranty Trust Bank PLC for and on behalf of Innoson Nigeria Ltd as a result of the Bank's indebtedness to Innoson Nigeria Ltd. In a landmark decision on February 27th 2019, the Supreme Court of Nigeria dismissed GTB's appeal – SC. 694/2014- against the judgment of Court of Appeal, Ibadan Division.

"The Court of Appeal, Ibadan division had in its decision of 6th February 2014 dismissed GTB's appeal against the Federal High Court, Ibadan Division.

"Thus, the Court of Appeal affirmed the judgment of the Federal High Court, Ibadan Division which ordered GTB by way of Garnishee order absolute – to pay N2.4 Billion to Innoson with a 22% interest, per annum, on the judgment sum until the final liquidation of the judgment debt.

"Rather than obey the judgment of the Court of Appeal, GTB approached the Supreme Court to challenge the Court of Appeal's decision.

"However in an ruling delivered by Honourable Olabode Rhodes-Vivour JSC on Wednesday, February 27th2019, the Lord Justices of the Supreme Court (JSC) dismissed GTB's appeal and thus affirmed the concurrent judgment of both the Court of Appeal and the Federal High Court, Ibadan Division which ordered GTB by way of Garnishee order absolute – to pay N2.4 Billion to Innoson with a 22% interest, per annum, on the judgment until the final liquidation of the judgment.

"The Judgment debt of N2.4B has an accrued interest as at today of about N6,717,909,849.96 which results to about N8.8 Billion.

"Based on the Supreme Court's decision of 27th February 2019 the counsel to Innoson, Prof McCarthy Mbadugha ESQ, had approached the Federal High Court, Awka Division for leave to enforce the judgment having obtained Certificates of Judgment from the Ibadan Division of the Federal High Court.

"Having obtained the requisite leave, the Federal High Court issued the necessary process for levying execution – the Writ of Fifa."

In response to the judgement, Erhi Obebeduo, company secretary of the bank, said: "The attention of Guaranty Trust Bank Plc ("the Bank"} has been drawn to statements circulating in the news and social media in respect of a purported enforcement of a Judgment of the Federal High Court, Ibadan, Oyo State. at one of its branches in Anambra State.

"The Bank as a law-abiding corporate citizen is taking all necessary legal steps to address this situation and ensure that no illegal or fraudulent execution is carried out.

"It is important to state that the Judgment allegedly in issue is in respect of Garnishee Proceedings against the account of the Nigerian Customs Service Board domiciled with the Bank and not against the Bank as an entity.

"The Bank remains committed to providing best-in-class customer experience to all its valued Customers."

What is a Writ of FiFa?

A Writ of Fieri Facias is a legal instrument issued after a judgement and it is used to seize the assets of a judgment debtor till the debt in question is settled.

Usually, only the debtor's property that can satisfy the judgment is held.

In the case of Guaranty Trust Bank, which has assets in trillions, only a portion of assets identified by the court would be held.

Will my deposits be affected?

Your deposits cannot be affected as they have been insured by the Nigeria Deposit Insurance Company (NDIC) and every bank has a deposit with the Central Bank of Nigeria (CBN), which it can get in desperate times to stay afloat.

Assets of the bank like buildings and its stake in other entities are on the line here and the shareholders of the bank will be ones to be affected by this if and when the payment is made.

Vice-President Yemi Osinbajo says a team of 63 fingerprint experts, including 50 from the UK police, worked to help the then Action Congress of Nigeria (ACN) reclaim some states that were allegedly rigged by the Peoples Democratic Party (PDP) in 2007.

He listed the states as Osun, Ekiti, Ondo and Edo. Only Ondo that was not under the control of ACN then but Bola Tinubu, then the leader of ACN, had used his influence in assisting Olusegun Mimiko, a former governor of Ondo, to take the state from the PDP.

Mimiko belonged to the Labour party at the time. He later defected to the PDP.

Speaking at the 11th colloquium of Bola Tinubu, a national leader of the All Progressives Congress (APC), the vice-president said Tinubu told him that they needed to prove that there was case of over voting.

"In 2007, when our party, then ACN, was rigged out of elections in Osun, Ekiti, Ondo and in Edo state. He invited me to his residence at bourdillion and he said the only way we can possibly reclaim the states that was taken away from us is going through the courts.
He said the only is by proving that there was multiple voting. Meaning that a few people singlehandedly thumb-printed ballot papers, dumped them into ballot boxes and they were counted in favour of the opposition, the PDP," he said.

"He said the only we can do this – he said 'I don't know how you will do this' – but some how proving that their is evidence that this is what happened.

"I said 'Asiwaju, nobody has ever proven that in an electoral case' and I said what is even more is that there are over a million ballot papers, how can we prove it? He said that was his view and I should look for a way of sorting this out.

"So I went to to the UK and met with possibly the most experienced [expert] in the entire UK. When I told the enormity of the problem, he laughed and almost fell off his chair. He said in all his experience as a finger print expert he has not done up to 4000 prints and you are now saying I should come and do 1.3 million finger prints. That was a Thursday and he called me back on Monday and he said let's talk again about this. And we did, and somehow we found a away.

"We used a bit of technology. Most importantly we were able to get finger print experts. In the end, we hired 63 finger print experts, 50 of them were from the UK police. Asiwaju had to persuade the authorities to release them all together 63 police men – they were working for almost six months.

"We were able to put together a strong forensic case that showed that that the places that were defeated it was on account of multiple voting. To cut the long long story short, one by one, we were able to get the states taken from us

A hard Brexit without a trade agreement would eliminate Britain's tariff-free trade status with the other EU members. Tariffs would raise the cost of exports .That would hurt exporters as their goods became higher-priced in Europe. Even with a trade agreement, a hard  Brexit could be disastrous  for The City, the U.K.'s financial center. Companies would no longer use it as an English-speaking entry into the EU economy. The City of London  reported that 5,000 jobs could be lost. That could lead to a real estate collapse. There are many new office buildings under construction that would sit empty. Housing prices have already started to fall.


The United Kingdom would lose the advantages of EU's state-of-the-art technologies. The EU grants these to its members in environmental protection, research and development, and energy. 

Also, U.K. companies could lose the ability to bid on public contracts in any EU country. These are open to bidders from any member country. The most significant loss to London is in services, especially banking. Practitioners would lose the ability to operate in all member countries. A hard Brexit could raise the cost of airfares, the internet, and even phone services.

A hard Brexit would hurt Britain's younger workers. Germany  is projected to have a labor shortage of 2 million workers by 2030. Those jobs will no longer be as readily available to the U.K.'s workers after Brexit. London is already losing many nurses and other health care professionals. In the year following the referendum, almost 10,000 quit. The number of nurses from Europe registering to practice in Britain has dropped  by almost 90 percent.

Under a hard Brexit, the U.K could lose Scotland. It could join the EU on its own, as some countries within the kingdom of Denmark have. It may even have a referendum to leave the United Kingdom. 


The most likely scenario is that nothing happens before the April 2019 deadline. In that case, the U.K. would no longer be a member of the EU, and it would have no trade agreement. It would have all of the disadvantages of a hard Brexit and there would be no trade agreement.

Britain would have to pay its outstanding EU bills of $51 billion. It would have to find a way to guarantee rights to EU citizens living in the U.K.Custom delays  could create  food shortages. The U.K. is vulnerable because an extreme heat wave and summer  drought caused by global warming  have already reduced food output.Tariffs would be reimposed. They are as high as 74 percent for tobacco, 22 percent for orange juice, and 10 percent for automobiles. That would hurt exporters. Some of that pain would be offset by a weaker pound.

Tariffs would increase prices of  imports into the U.K. One -third of its food  comes from the EU. Higher import prices would create inflation  and lower the standard of living for U.K. residents.Northern Ireland  would remain with the United Kingdom. The country of Ireland, with which it shares a border, would stay a part of the EU.


A no-deal Brexit would create a customs border between the two.

This could  reignite the troubles. It was a 30-year conflict in Northern Ireland between mainly Catholic Irish nationalists and pro-British Protestants. In 1998, it ended with the promise of no border between Northern Ireland and Ireland. It would also force  35,000 commuters to go through customs on their way to and from work. Some of those in Northern Ireland who want to remain in the EU could call for a referendum to rejoin the country of Ireland.Prime Minister May  has rejected  the EU proposal that there be a customs border between Northern Ireland and Great Britain. The United Kingdom is Ireland's second-biggest export destination. But under a no-deal Brexit, she would have no choice.


The Brexit vote has strengthened anti-immigration parties throughout Europe. As a result, Germany's Chancellor Merkel has already announced she will not run for re-election. If these parties gain enough ground in France and Germany, they could force an anti-EU vote. If either of those countries left, the EU would lose its most robust economies and would dissolve.On the other hand, new polls show that many in Europe feel a new cohesiveness. The U.K. often voted against many EU policies that other members supported. IMF Managing  Director Christine Lagarde said, "The years are over when Europe cannot follow a course because the British will object." She added, "Now the British are going, Europe can find a new elan." 


The day after the Brexit vote, the Dow fell by 610.32 points.Currency markets were also in turmoil. The  euro fell 2 percent to $1.11. The pound fell. Both increased the  value of the dollar. That strength is not good for U.S. stock markets . It makes American shares more expensive for foreign investors. As a result, gold prices  rose 6 percent from $1,255 to $1,330. 

A weak pound also makes U.S. exports to the U.K. more expensive. It affects the U.S farming and manufacturing sectors. The U.K. is America's fourth-largest export market.U.S. companies invested $588 billion and employed more than a million people. These companies use it as the gateway to free trade with the 28 EU nations. Many have opened subsidiaries elsewhere in Europe to protect against a hard Brexit or no deal.Britain's investment in the United States is at the same level. That could  impact up to 2 million U.S./British jobs. It's unknown exactly how many are held by U.S. citizens. The uncertainty over their future will dampen growth. 


Brexit is a vote against globalization. It takes the United Kingdom off the main stage of the financial world. It creates uncertainty throughout the U.K. as The City seeks to keep its international clients. U.S. stability means London's loss could be New York's gain.  


In June 2016, The former Prime Minister David Cameron called  for the referendum. He wanted to silence pro-Brexit opponents within his Conservative party. He thought the referendum would resolve the issue in his favour. Unfortunately for him, the anti-immigration and anti-EU arguments won.They felt that EU membership was changing their national identity. They didn't like the budgetary constraints and  regulations  the EU imposed. They didn't see how the free movement of capital and trade with the EU benefited them. Younger voters and those in London,  Scotland ,and Northern lreland wanted to stay in the EU. They were outnumbered by older voters who turned out in droves.

Innoson Motors secures court order against GTBank over controversial debt

A Nigerian car manufacturing company claims it has obtained a court order that allows it to take control of one of the country's largest banks.

Innoson Nigeria Limited on Friday said it obtained a writ of Fifa from the Federal High Court in Awka, Anambra State, against Guaranty Trust Bank (GTB) to implement the judgment given by Nigerian courts over the lingering crisis between it and the bank.

The company in a statement signed by its spokesperson, Cornel Osigwe, said a judgement given by the Federal High Court in Ibadan was upheld by the Supreme Court of Nigeria.

A Writ of Fieri Facias (or Writ of Fi Fa) is a document issued by the court for the purpose of effecting court judgment on a debtor's property. It is also the legal instrument by which the assets of a judgment debtor may be seized.

Innoson and GTB have for long been locked in legal tussles following disagreements over a business deal.

On Friday, Innoson claimed its Chairman, Innocent Chukwuma, has been mandated to "take over" GTB after the supreme court dismissed GTB's appeal against the judgement of the appeal court in Ibadan.

"The Chairman of Innoson Group, Chief Dr. Innocent Chukwuma, OFR has through a Writ of FiFa taken over Guaranty Trust Bank PLC for and on behalf of Innoson Nigeria Ltd as a result of the bank's indebtedness to Innoson Nigeria Ltd," the statement said.

The company in its statement said a ruling delivered by Supreme Court Justice Olabode Rhodes-Vivour dismissed GTB's appeal and thus affirmed the concurrent judgment of both the Court of Appeal and the Federal High Court, Ibadan Division.

The ruling, it said, ordered GTB by to pay N2.4 billion to Innoson with a 22 per cent interest, per annum, on the judgment until the final liquidation of the judgment.

"The Judgment debt of N2.4bn has an accrued interest as at today of about N6,717,909,849.96 which results to about N8.8 billion," the statement said.

"Based on the Supreme Court's decision of 27th February 2019 the counsel to Innoson, Prof McCarthy Mbadugha ESQ, had approached the Federal High Court, Awka Division for leave to enforce the judgment having obtained certificates of Judgment from the Ibadan Division of the Federal High Court."

Mr Chukwuma, the founder of Innoson Motors, dragged GTBank to court in 2011, alleging arbitrary charges levelled against him and a string of bank accounts he held at the bank. But GTBank later counter-sued, saying it was Mr Chukwuma who allegedly falsified bank and shipping documents to obtain tax waivers from the Nigerian government.

The bank subsequently referred the matter to the Economic and Financial Crimes Commission (EFCC). The anti-graft office filed criminal charges against Mr Chukwuma at a Lagos court. Last month, he was declared wanted for failing to appear for arraignment in the matter, which is still proceeding separately from the N14 billion arbitrary charges lawsuit currently at appellate levels.

Mr Chukwuma denied the allegations of doctoring shipping documents, saying the matter had previously been investigated by the EFCC and the police both of whom cleared him of any wrongdoing.

He accused GTBank of using law enforcement agencies to hound him and cripple his business, a claim the bank also denied.

Efforts to get GTB's reaction to the latest development were unsuccessful as of Friday evening

Dear Chief Tinubu,

The backpage of your The Nation of Tuesday 12 March where one of your Rottweilers under the FORGED name "Segun Ibirogba" wrote "Odumakin's anxiety over vanishing feeding-bottles" has un-paused the button on this serial.

I have always wondered why these intellectual almajiris around you always attack me under fake names.It is either they are afraid of me or they don't believe in you to risk their names doing the dirty job for you .Well,we know many of them hold worst views about you than us but for the free money they have been accustomed to from a Robbin Hood.

The piece referenced was a rehash of same old silly lies and freshly minted ones.In keeping faith with my resolve that for every dart of lie you guys throw in my direction ,I will return 10 bombs of truth I make this response.And for every line I write,I can say like Fela Anikulapo-Kuti "Na true I wan talk again o,if I dey lie o,make Edumare punish me o".

Since you guys made a failed attempt to impugn my integrity ,I have chosen to use this edition to place your life side-by-side mine on the scale of integrity so we can know if your hen can point at the boil in a hawk's eye.I intend to show that were it not that Nigeria has become Ceaser's palace where the leper holds the veil,nobody in your circle should move near that subject.

I am Yinka Odumakin and nobody can say he had known me under any identity in my life .I have led a straight life unlike you that people know under different identities depending on where they met you in your about 80 years on earth .Yes,80!

Those of us who are knowledgeable about you cant buy your 66 claim for so many reasons .The current governor of Osun is the son of your immediate senior sister from Iragbiji and he is 63 while you are claiming 66. Your first wife died in Lagos recently unannounced at 74 .

When the son he had for you died many moths earlier his age had to be doctored to fit into the lie that you live. And there is a photograph of yours at the palace of Soun Ogbomoso in 1974 when the current monarch was installed with a bottle of beer and packet of cigarette in your front. You mean you were 20 when you were drinking and smoking in a palace ?

There is no school I have attended in my life that my classmates would not come out in droves to say "yeah, we were there together!". From St Augustine Primary School, Ondo to CAC Grammar School, Edunabon and Oduduwa College Ile -Ife down to Obafemi Awolowo University, Ile -Ife and University of Ghana.

At your end St John Primary School Aroloya you claimed may be created by your new governor in Lagos. The old boys of Government College Ibadan were planning a reception for you when someone asked which set you belonged to .There has been no answer to that till date and the reception was cancelled. The tales by moonlight on Chigago State University and University of Chiicago are all over the place.

My parents are alive in Osun and by God's grace I will give them a befitting burial. I will not have to send emissaries to bury them since I have not abandoned "moomi" (that's how we Oyo people in Osun call mummy) to be calling another woman "maami" in Lagos to fit a life of lie and greed. No Mama HID Awolowo would have told me that she knew all the children of "maami " and that I was not one of them.

My parents are not rich but I am proud of them because it is from their black pot that my white palp has come out. I say proudly among my University mates today that they could not afford more than N60 per month for me throughout my University days .The story of grass to grace is a proud thing among the Yoruba. MKO Abiola was proud of the story that he ate egg for the first time in his life in the home of Simbiat Abiola's parents.

With the modest means of my parents, they instilled so much values in me that there is no crime attached to my name in all my years on earth. Forging traveling passports had never appealed to me. Neither has my name been linked to a narcotic ring leading to inquiry and forfeiture of assets. All my life, my hands have provided for me. And they have provided for you too.

I recall when you returned from exile in 1998 and running for governor. You were not "Ezeego" then. You had only the Sunday Adigun house and all the four cars you used then belonged to Mr Ganiyu Solomon. There were a lot of printings being done for you by your friends at The News. I saw the price you were being offered and I told you my press could do it at 40%. I delivered and saved you 60%. I recall Mr Babafemi Ojodu complained openly that they could not do the price I offered you !

That should tell you and your attack dogs that I have always separated the cause I believe in from what I would eat unlike you who always mix the two. You pose as a June 12 hero today but Kola Abiola is alive to tell the story of what happened to MKO's money as Bashorun is no longer alive. In 20 years, there is hardly any boundary between Lagos treasury and your private pockets. Your "O to ge" moment is coming some day and all the dirty deals will be out.

Like a rapist, you can tell your victims to shout "O to pe" for as long as stolen funds and drug money rule Lagos politics.

I have noticed that because you and your followers have no abiding principle and you are driven by only lust for money, you assume it is so for everybody. Your being glued to the lowest of all spirits (money) makes it difficult for you to make the right judgement about people thinking they are all about money. Was it that you didn't have money when I told you in December 2006 that it was over between us politically? Have I ever looked in your direction ever? There are men who may not be able to give N10,000 to a cause but if they say they want to see me at 8AM I would be there at 7. Can you summon me with all your bullion vans?

I recall how you said to me in 2006 about Senator Tokunbo Afikuyomi and I quote you "Adiye ni Tokunbo, yin agbado fun a pada" (Tokunbo is a fowl, throw corns and it is U-turn). Has he not turned his back at you today? You don't have "corns " again? This was the man who was your fall guy when you made all the forgeries in 1999. He was among the team that went to bury your biological mother in Iragbiji when you could not show your face, has his exit not shown you there are men who place value on principle than money?

I have lived my political life on the basis of the fact that an adversary today can be an ally tomorrow and vice versa. I am not beholden to any person outside the core beliefs we share. One of the men I had an open disagreement with was President Obasanjo and when we reconciled it was an open thing. That differentiates me from you who walk both sides of the streets simultaneously. You were with NADECO and also in bed with Abacha through whom you forged friendship with the Chagourys who are your business partners till date.

The political buffoons around you would hold you out as an anti-third term person today but you know what happened between us on May 2, 2006. We had a meeting at Airport Hotel in Lagos where you were dictating the communique against third term unknown to participants you were at a meeting till wee hours of that morning to work third term in another way.

I was reading the communique to the press when you called me. I gave the phone to the late Rev Tunji Adebiyi but you told him you wanted to speak with me. We didn't get to talk till late in the night. I had with me in the car as you spoke with me from VGC to Ikeja then President of Egbe Omo Yoruba in North America, Mr Odusanya. Let me quote you verbatim :

"I hope you have not released that communique. We need to manage this third term carefully. Obasanjo is a blind cat. If he causes problem now and they kill one Yoruba graduate in Kano and we kill 200 people selling onions in mile 12 it is not equal. I am therefore proposing that we have a win-win situation. Instead of outright third term we can have the confab recommendation of one six-year tenure starting with the incumbent having 2 extra years and so with we the governors. We can use the two years to empower people like you and handover to one of you. I have asked General Alani Akinrinade to come and I am going to meet Prof Soyinka to discuss it. I want you to think about it"

I told you as a matter of fact that the proposition was unreasonable and there was nothing for me to think about as I would prefer outright third term where we would have elections to automatic two years extension. But my eyes were opened to how unreliable you are that night. Here was a man dictating communique against third term in the morning having this conversation with me at night.

They have so much tomatoes in Spain that once a year the Spanish will come together and have a very big tomato fight on the street. They will come with truck loads of tomatoes and people can fight each other with it all day. It is tradition and nobody gets hurt. But when you go to Spain just make sure you stay away from the Bull Run. That one also happens every year but don't mix them up.

In Nigeria, many brilliant people thought the problem of tomatoes shortage was there wasn't enough processing power to process the tomatoes produced, and were left to rot. Mr. Aliko Dangote got that information too, so he thought why not build a mega tomato factory to process all that tomatoes?

But he thought lets have a plan B. Lets recruit more farmers to produce tomatoes in case the present capacity was not enough.

As it happened, when the factory was completed the tomatoes available in Nigeria could only run the factory for few weeks and there wasn't enough tomatoes. The country produce too little. Where are all the tomatoes the Minister said were spoiling in Nigeria due to lack of processing power? Stories.

Monumental Fraud!Lagos Rail Project

The Lagos Light Rail may go in the history of Nigeria and Africa's history as the railway that took almost 20 years to finish. The first section of the network, Phase I of the Blue Line, was originally planned to be completed in 2011. After many delays caused by funding shortfalls, the opening date was revised to 2022.
The Lagos State Government last year (2018) announced that its light rail project running between Mile 2 and Marina will now commence passenger operation in 2022.The mass transit rail project called the Blue Line awarded to China Civil Engineering Construction Corporation had suffered many delays due to the paucity of funds and other challenges. The Lagos Light Rail started 2008, same time Ethiopia started its railway and so far, they have been at the same location for the past four years.

For some of us who ply through Eko-Bridge, Leventis and Apogbon area regularly, you must have noticed some giant beams which are built close to the main bridge. The bridge belongs to the Lagos Light Rail, this is the carriage for the train that will stop at CMS.

Voxipopulid observed that some of the infrastructures that are already completed like those in Mile 2, Orile, Iganmu is already decaying, some have turned to a hideout for criminals as no one uses them. We are at Eko Bridge to observe the construction and report live from the scene, we can say that nothing tangible has been done thus far.

The workers of CCECC were either gisting, sleeping or strolling around. We met with a worker and asked why the work was slow for almost years, the worker said, "The state government has refused to release money and the CCECC company has laid off some workers when there is little cash to cater for all the workers.It will be recalled that in August 2018, LAMATA signed an agreement with Alstom. As a part of the agreement, Alstom conducted a review of the rail lines. After the review of the rail project, which should have initiated passenger activity, the state government said the Blue Line, would now be ready for passenger operation by 2022. This deal also plans for the electrification of a portion of the track.

Now that Lagos has a new governor, we hope this will be taken care of as soon as possible and also be a major front burner for him

Rough Time Ahead For Saraki

There is a possibility that Senate President Bukola Saraki might be in for a rough time in the coming days if details of this story are anything to go by.The EFCC reports have it has arraigned a Deputy Chief of Staff to the Senate President on an 11 count charge which borders on conspiracy and money laundering.

The Economic and Financial Crimes Commission (EFCC) on Wednesday rearraigned Gbenga Makanjuola, a Deputy Chief of Staff to Senate President, Bukola Saraki, before Justice Maureen Onyetenu of the Federal High Court sitting in Lagos on an amended 11-count charge bordering on alleged conspiracy, accepting cash payment beyond threshold and money laundering to the tune of N3.5billion.

Makanjuola was charged alongside Kolawole Shittu, cashier to the Senate; Robert Chidozie Mbonu, a former Managing Director, Societe Generale Bank of Nigeria, who is at large; Melrose General Services Limited; and Obiora Amobi, Operation Manager, Melrose General Services Limited.

The EFCC had submitted a report to President Muhammadu Buhari linking the Senate President and some of his aides to the diversion of the sum of N19billion from the N522.74billion Paris Club refund.

At the resumption of hearing, EFCC counsel Bashir Kamil informed the court that today was slated for the re-arraignment of the defendants due to the transfer of Justice Babs Kuewumi, who was handling the case earlier.Justice Onyetenu ordered that the charge be read to defendants for their plea to be taken.

One of the counts read: "That you, Gbenga Makanjuola, sometime in December 2016 in Nigeria, within the jurisdiction of this Honourable Court, did accept cash payment of the sum of $500,000.00 (Five Hundred Thousand Dollars Only) from Kolawole Shittu without going through a financial institution and thereby committed an offence contrary to Section 1(a) of the Money Laundering Prohibition Act, 2011 (as amended by Act No. 1 of 2012) and punishable under Section 16 (2) (b) of the same Act.

"That you, Robert Chidozie Mbonu (now at large) and Melrose General Services Limited between the 14th day of December, 2016 and January 2017 in Nigeria, within the jurisdiction of this Honourable Court, took control of the sum of N3,500,000,000.00 (Three Billion, Five Hundred Million Naira Only) transferred from the Nigerian Governors' Forum's account into Access Bank Plc account number 0005892453 by Melrose General Services Limited, when you reasonably ought to have known that the said fund represented the proceeds of lawful activities to wit-conspiracy, stealing and fraud, and thereby committed an offence contrary to Section 15(2) (9) of the Money Laundering (Prohibition) Act, 2011 (as amended by the Act No.1, 2012) and punishable under Section 15( 3) of the same Act."

The defendants pleaded not guilty to the charges preferred against them.

In view of their pleas, Bashir Kamil, the prosecution counsel, asked the court for a trial date. However, Okwudili Anozie, counsel to the second and fourth defendants, holding the brief of Paul Erokoro (SAN), applied that the court should allow defendants continue on the bail earlier granted by Justice Babs Kuewumi who was transferred out of Lagos earlier this year.

Also, Omeoga Chukwu, counsel to the third defendant, urged the court to allow his client continue on the existing bail.Consequently, Justice Maureen Onyetenu granted the defendant application to continue on the existing bail earlier granted and adjourned till May 20, 21 and 22 for trial

Gbenga Daniel Speaks On Late Sugar

"In setting the records straight my only comment is that 'Sugar' was barnished from Odeda to Oyo State during my tenure as EXECUTIVE Governor. I do not believe that fact supports the statement that someone got an official cover during OGD days. Let us be guided and well informed before drawing conclusions on order to preserve our democracy. Our administration suffered a great deal from deliberate negative propaganda including operating a Killer Squad yet there were no dead bodies. Let us remember that this outgoing government, the most hostile administration in history to his Predecessor set up a Truth Commission in 2011 with the aim of indicting our administration. 8 years later, no one  in my administration have been charged for any violent crime. Let us 'shine' our eyes using that popular parlance. I think I will need to write 'Daniel In Lions Den Part II' very soon. OGD"

Flashback:Report Of The Committee That Investigated Buhari's PTF

As the brickbat between President Muhammadu Buhari and former President Olusegun Obasanjo continues over 2019, The WHISTLER refreshes your memory on the terms of reference and recommendations of the Interim Management Committee set up to look into the affairs of the Muhamadu Buhari's Petroleum (Special) Trust Fund.

The committee was expected to account for how much is spent by the Buhari's PTF so far and what is on ground to justify the huge expenditure.

The Committee was set to work and accomplished all the terms of reference by March 2000.

The Interim Management Committee therefore discovered the total income that has accrued to PTF from its inception to date.

The total amount that has accrued to PTF is N 181, 795, 000, 000 (One hundred and eighty-one billion, seven hundred and ninety-five million Naira). The report for the ascertainment of accrued income has been completed.

Independent Consultants were commissioned by the Interim Management Committee to ascertain the state of all the bank accounts operated by PTF from its inception up to September 1999. All the assignments are said to have been completed.

The Petroleum Special Trust Fund intervened in, prepared and packaged, ready for transfer to the appropriate line ministry

Food Supply Sector All the necessary verification work has been concluded for projects and programmes and reports already supplied by independent consultants. The programme is already in the process of being transferred to the appropriate ministry, as per the approval given by Mr. President.

(c) Education Sector

Educational Materials Procurement Programme: The verification of the entire programme has already been done and the process of handing over the whole programme to the appropriate beneficiaries has reached an advance stage as directed by Mr. President

Rehabilitation of Educational Institutions: The services of various consultants have been used to carry out the technical audit of all the projects throughout the country and a comprehensive up to date report has already been completed by the coordinating consultants. The preparation of an Executive Summary has reached an advanced stage.

(d) Health Sector:

(i) Drug Revolving Fund: The drug revolving fund programme has been thoroughly verified and all available stocks have been transferred to the various state governments. As per the directive of Mr. President

(ii) Rehabilitation of Health Institutions: The programme for the rehabilitation of Health Institutions throughout the country has been verified and a comprehensive up to date status report prepared. And Executive Summary for the attention of Mr. President is being prepared

(e) Water Supply Sector: All projects and programmes under this sector have been thoroughly verified in compliance with the terms of reference No 3. A comprehensive and up to date report has already been completed.

(f) Other Project Sector: The projects under the sector which were commenced have already been completed. The rest of the projects are yet to commence. The report stating the above mentioned up to date status of all projects under this sector has already been completed

The audited account of the fund as at 30th June 1999 stating the Assets and Liabilities of the Petroleum Special Trust Fund has already been prepared by the KPMG Audit, a firm of Chartered Accountants. (ii) The Audited Accounts of the fund as at 31st December 1999 stating the Assets and Liabilities of the fund has already been prepared by Price water house Coopers Audit, a firm of Chartered Accountants. (iii) The Audited Accounts of the Fund for the month commencing January 2000 to June 30th, 2000 is to commence when the IMC was replaced. This would have given the asset and liabilities of the Fund at the end of the terms of the former IMC.

The present administrative structure was carefully examined, and the best option is to transfer each departmental staff operating a project sector to the appropriate ministry where the projects are transferred. This will reduce hardship on the staff and will enhance the capacity of the ministry concerned for it to cope with the additional responsibility.

The former IMC has undertaken a thorough technical audit of all projects and programmes using well experienced independent consultants. In the process of the technical audit, the sanctity of all contracts agreement was upheld, and all costs were evaluated to a realistic level. The value of work done up to date has been ascertained and the estimated cost of completion has also been calculated. The appropriate ministry that will be responsible for the completion of any project may further negotiate the time and cost of completion of any project.

As it has been enumerated above, all the terms of reference given to the former IMC has already been virtually completed. The handing over of projects to respective ministries has already commenced. The former IMC would have completed the winding down of the activities of the Petroleum Special Trust Fund as directed by Mr President by the end of June 2000.

The total public funds to be recovered from various contractors, banks and consultants amounted to about Twenty-five billion, seven hundred and fifty eight million five hundred and thirty two thousand four hundred and forty eight Naira.

Below is the Executive Summary of various reports of the independent consultants on verification exercise which resulted in the funds recoveries.

Report On The Amount To Be Recovered From Some PTF Projects And ProgrammesThe Interim Management Committee was appointed by Mr President. One of the terms of reference of their appointment is to carry out verification exercise on all projects and programmes prior to packaging the projects and programmes for subsequent transfer to the appropriate line ministries. The recoverable exercises of the under-listed projects were completed, and the various reports and the IMC recommendations forwarded to President Obasanjo for further directives.


The Listed Projects Are –

(i) Afriproject Consortium (APC) PTF Management Consultants and also Project Consultants (ii) PTF intervention in the HIV/AIDS Programme (iii) PTF Health Sector Intervention inputs (iv) PTF Prevalent cases of expiring drugs all over the country (v) PTF residential estate development on Plot 780 Cadastral Zone A8, Abuja FCT (vi) PTF Head Office extension contract at Airport Road, Abuja (vii) PTF-Bank accounts operated from inception to 31st December 1999.

AFPRI- Project Consortium (APC) Afri-Project Consortium were contracted by PTF as Management Consultants and Project Consultants. The former Chairman of PTF also delegated to them the power of Engineer in all appropriate project requiring such power. Afriproject Consortium then assumed an absolute power of initiation, approval and execution of all projects.

Three reputable management consulting firms were engaged to verify all payments made to (APC) from the inception of PTF up to 30th September 1999. On verification it was found that they have over charged PTF for their services to the tune of N 2, 057, 550, 062 (Two billion fifty-seven million five hundred and fifty thousand and sixty-two Naira only).

(ii) PTF Assisted HIV/ AIDS Programmes: The intervention of PTF in the HIV/AIDS was flawed due to professional negligence by the management consultants. There was an excessive order of HIV/AIDS kits which resulted in most of the kits expiring before use. Also, there was gross inflation of the purchase price. The two factors combined resulted in a loss of N 579,000,000 (Five hundred and seventy-nine million Naira only).

(iii) PTF Intervention Programmes: PTF intervention in the health sector input programmes totalled to about N 9 billion Naira. The projects were executed by the management consultants and PTF in-house staff. In this sector there are three glaring areas of loss: (a) Purchase of specific frames which was done at N 1,900 each while they can be purchased locally at a price between N 80 and N 880. This resulted in total loss of N 45, 270,000 (b) Purchase of ambulances which was done at N 13,000,000 each instead of the price of N 3,000,000 each. This resulted in total loss of N 900,000,000 (Nine hundred million Naira only). (c) Purchase of drugs was done to the tune of N 3.08 billion. Price inflation and expiring of drugs resulted in a loss to PTF of about N 1, 500, 000,000 ( one billion, five hundred million Naira).

(iv) PTF Prevalence Expiring Drugs All Over The Country: A team of Pharmacists were commissioned to verify the Drugs Revolving Fund Programmes. Their findings were very depressing. A huge loss has been incurred by PTF as enumerated below:- (a) Drugs and consumables worth N 817, 831,723 (Eight hundred and seventeen million, eight and thirty one thousand seven hundred and twenty three Naira only) were found to have expired by October, 1999 (b) another quantity of drugs worth N 94, 741, 517 expired in December, 1999 (c) drugs worth N 233, 416, 829 will expire by March 2000 (d) Drugs worth N 461, 255,073 will expire by June 2000 (e) Drugs worth N 429, 117, 861 will expire by September, 2000 (f) Drugs worth N 1, 196, 276, 052 will expire by October- December, 2000.

There were many cases of deterioration of drugs as a result of faulty manufacturing, inappropriate packaging, improper storage and excess stock.

(v) PTF Residential Estate: The involvement of PTF in Residential Estate Development was out of its intervention sphere. As at now, the estate has been confiscated by government. The contract sum is N 703, 815, 416 (Seven hundred and three million, eight hundred and fifteen thousand four hundred and sixteen Naira only) while after verification, the whole project was valued at N 328, 901, 521 (Three hundred and Twenty Eight Million nine hundred and one thousand, five hundred and twenty one Naira only). There was an inflation of the contract to the tune of N 374, 913, 895 (Three hundred and seventy four million, nine hundred and thirteen thousand eight hundred and ninety five Naira only).

(vi) PTF Headquarters Extension: The IMC Commissioned Consultants to determine the current construction cost of the on-going extension at the headquarters office. The current construction cost determined by the Consultant came to N 326, 207, 861 (Three hundred and twenty six million, two hundred and seven thousand, eight hundred and sixty one Naira only) as against a contract sum of N 461, 216, 759 (Four hundred and sixty one million, two hundred and sixteen thousand, seven hundred and fifty nine Naira only) this resulted in contract sum inflation of N 135, 008, 879 (One hundred and thirty five million, eight thousand eight hundred and seventy nine Naira only).

Bank Accounts Operated By PTF From Inception To December 31, 1999: Various Consultants were commissioned to verify the Bank accounts operated by PTF from inception of the Fund up to 31st December, 1999. The Fund operated its bank accounts under three different categories viz- (a) Administration Account (b) Project Account (c) Treasury Account. Recoveries to be made from the various banks are as follow:

(a) Administration Account Total Amount recoverable is N 664, 415, 793 (Six hundred and sixty four million, four hundred and fifteen thousand seven hundred and ninety three Naira only). This is mainly due to overcharge on Cost of Turnover (COT), nonpayment of interest on current account balances as stipulated by Central Bank of Nigeria (CBN) and other various discrepancies.

(b) Project Account On project Account, total amount recoverable is N 2, 467, 817, 167 (Two billion, four hundred and sixty seven million, eight hundred and seventeen thousand, one hundred and sixty seven Naira only). This is made up mainly from overcharge of Cost of Turnover (COT), non-payment of interest on Current Account balances as stipulated by Central Bank of Nigeria (CBN) and other various discrepancies.

(c) Treasury Account All the Treasury Accounts were verified and amount to be recovered is N 510, 749, 323 (Five hundred and ten million, seven hundred and forty nine thousand, three hundred and twenty three Naira only). This is mainly due to short-payment of interest on deposited funds. (See Box A).

The total sum of N 11, 658, 532, 448 (Eleven billion, six hundred and fifty eight million, five hundred and thirty two thousand four hundred and forty eight Naira only) is recoverable as per various reports completed as at now.

1.Other Potential Areas Of Fund Recovery : Road (Highways and Urban Roads) The PSTF uses about 70% of its income on highways and Urban Road Projects. In this project sector, there was total variation of contract sums of N 68,000,000,000 (Sixty eight billion Naira). These variations were not done with properly priced bills of quantities and approved civil contracts procedure as stipulated by government regulations. Taking the experience of what has been discovered after verification of previous contracts awarded by PSTF, the minimum potential recovery will be about 15%. This estimated percentage will be about N 10, 000, 000 (Ten billion Naira). The verification of this project sector was about to take off when the IMC members were replaced.

2. Rural Water Supply Programme The area of potential fund recoveries under this programme are basically two :- (i) Mobilisation paid to contractors who by now have not even commenced work (ii) Over pricing of contracts. The amount to be recovered from this project sector can be conservatively estimated at N 1,000,000,000 (One billion Naira).

The detail verification report on this programme has already been completed. The executive summary of this report was in the process of compilation when the IMC members were replaced.

3. National Health and Educational Institutions Rehabilitation Programme The detail verification exercise on this sector has already been completed by various independent Consultants. The executive summary for total amounts recoverable is now in the process of being compiled. The conservative estimate of amount recoverable due to non-performance of contractors and over-pricing of contract is about N 600,000,000 (Six hundred million Naira).

4. National Educational Material Procurement Programme This programme entails the purchase of educational materials such as text books, exercise books, chalk, dusters, pencils, biro, magazines, maps etc. The verification exercise of this programme is yet to commence. The conservative estimate of recoveries to be made due to non-performance by contractors and inflation of prices will be in the region of N 900,000,000 (Nine hundred million Naira).

5. Rural Telecommunication Programme The Rural Telecommunication Programme was supposed to be carried out in two phases viz: – (i) Pilot programme (ii) The main programme. The main programme was to commence after the pilot programme has been completed and certified as operational, but mobilisation of N 1, 600,000 (One billion, six hundred million Naira) was paid to the contractors for the main programme without any contract being signed at all.

In view of the government policy at present, the full amount of the mobilization paid can be recovered (i.e N 1,600,000,000), See Box B

The Committee recommended that the total recoverable amount can be used to offset some of the outstanding debts because some of the creditors are contractors from whom these amounts are to be recovered. It also recommended that the President may wish to set up a high powered judicial panel to recover the huge public fund and to take the necessary action against any officer, consultant or contractor whose negligence resulted in this colossal loss of public funds
